Meta Sued in Australia Over Alleged Harm to Children

Guardii Analysis

Australian law firm MinterEllison filed a class action lawsuit against Meta in the Federal Court on October 9, 2026, on behalf of children and teenagers who allegedly suffered harm from addictive design features and exposure to harmful content on Facebook and Instagram, seeking compensation for current and former users. The announcement came days after the Australian government indicated it would take enforcement action against Meta and other social media companies for failing to comply with safety regulations under the world's first social media ban for children under 16, which took effect in December 2025. Australia's eSafety Commissioner reported that 42 percent of children aged 10 to 15 still own a social media account, and Communications Minister Michelle Rowland stated that the eSafety Commissioner believes the five platforms in particular could be doing more to comply with the law and is investigating potential violations.

Blanket age-based restrictions on platform access displace compliant users but leave offenders free to operate on unmonitored channels or through accounts that evade verification, and enforcement challenges persist when minors retain access despite the ban. Detection of abuse and exploitation patterns within the messages children do receive addresses the harm itself rather than relying on access controls alone. The anti-grooming, anti-sextortion, and anti-CSAM detection capabilities intercept sustained targeting, escalation, and coercion in direct messages in real time across platforms, surfacing a child in crisis to a parent, school, or professional before harm occurs. This targeted approach, operated by a Meta Business Partner and backed by Startmate, complements enforcement of age restrictions by addressing the active threats that persist when children gain access, and it reports the shape and seriousness of a conversation rather than requiring every user including adults to prove their age.
