ENFORCE Act Passes Senate Unanimously; Equalizes Penalties for AI-Generated CSAM

On December 16, 2025, the U.S. Senate unanimously passed the Enhancing Necessary Federal Offenses Regarding Child Exploitation (ENFORCE) Act, sponsored by Senators Cornyn, Blumenthal, Lee and Kennedy. The Act ensures that offenders who use generative AI to create or distribute child sexual abuse material and obscenity are subject to the same statutory penalties as those who create or distribute other forms of child pornography. The legislation responds to a documented rise in the use of visual generative machine learning models to create highly realistic CSAM.
Equal legal accountability does not guarantee equal operational visibility.
