Danish Supreme Court Rules AI-Generated Child Abuse Images Illegal

Guardii Analysis

Denmark's Supreme Court upheld the conviction of a 31-year-old man for creating and distributing over 36,000 AI-generated images depicting child sexual abuse, ruling that AI-generated material is as illegal and punishable under Danish law as images depicting the physical abuse of real children. The decision sets a legal precedent for the treatment of AI-generated abuse content in Denmark, establishing that synthetic CSAM carries the same criminal liability as traditional CSAM regardless of whether an identifiable victim is depicted. The ruling addresses a gap exposed by rapid advances in generative AI, which have enabled offenders to produce realistic abuse imagery at scale without direct contact with a child.

Criminalizing the creation and possession of AI-generated CSAM establishes liability after material has been produced or distributed, but it does not prevent the initial production or interdict the coercive use of that material in real time. Detection systems operating at the conversation level, rather than at the point of prosecution, can identify when synthetic or manipulated imagery is being deployed as a weapon in a sextortion or grooming scenario. Guardii's anti-CSAM and anti-sextortion detection flags conversations in which fabricated material is shared or threatened, whether to humiliate, coerce, or groom a child, enabling intervention before the child complies with further demands or the material is distributed beyond the initial exchange. This operational capability complements criminalization by moving the point of interdiction upstream from prosecution to prevention, blocking the offender and routing the threat to the appropriate authority while the child is still protected.
