California Governor Signs Bill Banning AI-Generated CSAM

Guardii Analysis

California Governor Gavin Newsom signed Assembly Bill 1831 into law on October 15, 2026, making it a felony to create, distribute, or possess AI-generated child sexual abuse material. The legislation expands existing CSAM prohibitions to explicitly cover synthetic and deepfake imagery, carrying penalties of up to three years in state prison. California becomes the eighth U.S. state to enact specific criminal provisions against AI-generated CSAM, joining a legislative response to what prosecutors describe as an exponential increase in computer-generated exploitation material circulating online.

Guardii's anti-CSAM detection module, operating at the point of transmission across Instagram, Snapchat, Discord, Roblox and other platforms, identifies both photographic and AI-generated child sexual abuse material in direct-message conversations before it reaches a recipient, flagging the exchange for intervention without exposing moderators or parents to the content itself. Criminal prohibition establishes liability after material is created or shared; the Guardii platform, a Meta Business Partner backed by Startmate, intercepts the sharing attempt in real time, addressing the harm the California statute targets while enabling immediate escalation to law enforcement when synthetic CSAM is detected in a conversation involving a minor.
