Victorian schools to get new cyberbullying powers under state government crackdown

Guardii Analysis

The Victorian government announced on 9 October 2024 that it will grant state schools explicit authority to suspend or expel students for serious cyberbullying that occurs outside school grounds and hours, closing what Education Minister Ben Carroll described as a regulatory gap that has left principals uncertain about their disciplinary jurisdiction over off-campus online abuse. The new powers, to be legislated in early 2025, will apply when cyberbullying has a demonstrated impact on school operations or student safety, and will require schools to document the connection between the online conduct and on-campus harm. The announcement follows a submission from the Victorian Principals Association citing cases where students subjected to severe online harassment outside school hours have disengaged from learning or refused to attend, but principals have been unable to take formal disciplinary action against perpetrators because the conduct occurred on private devices and platforms beyond the school gate.

Expanded disciplinary reach does not substitute for preventing the abuse from arriving in the first place. Detection technology that identifies coercion, sustained targeting and escalation as the conversation unfolds intervenes before a child is harmed enough to disengage from school, and before an incident requires a principal to reconstruct a trail of off-campus messages to establish jurisdiction. Guardii, backed by Startmate and operating as a Meta Business Partner, deploys real-time cyberbullying filters across the major platforms young people use, surfacing a child in crisis to parents or school safeguarding staff and blocking hostile contact at the point it is sent, addressing the underlying harm without the trade-off of after-the-fact disciplinary procedures that depend on a victim coming forward or a harmful pattern being discovered only once the damage is done.
