US Senators Richard Blumenthal and Marsha Blackburn have reintroduced the Kids Online Safety Act, legislation that would impose a duty of care on social media platforms to prevent and mitigate harms to minors, including sexual exploitation, bullying and content promoting self-harm, suicide or eating disorders. The bill would require platforms to enable the strongest privacy and safety settings by default for users under 18, provide parental controls, and allow independent researchers to audit platform safety systems.
A statutory duty of care establishes liability but does not itself generate the detection capability required to intercept harm before it reaches a child.
