UK Online Safety Act: Ofcom Publishes Final Illegal Content Codes and Guidance

Guardii Analysis

UK communications regulator Ofcom published on 19 August 2024 its final codes of practice and guidance for illegal content under the Online Safety Act, establishing detailed obligations for platforms to prevent the spread of child sexual abuse material, terrorism content and other criminal harms. The codes set out risk-assessment frameworks, content-moderation standards and reporting requirements for regulated services, with enforcement powers including fines of up to ten per cent of global revenue. Platforms classified as Category 1 services face additional duties regarding the design and operation of algorithmic recommendation and search systems that may surface illegal material to users, particularly children.

Statutory moderation standards define the floor, not the ceiling, of what is achievable in protecting minors online. Real-time monitoring systems such as Guardii analyse direct-message streams across Instagram, Snapchat, Discord, Roblox and other platforms to detect grooming, sextortion and child sexual abuse material as conversations develop, blocking harmful contact before it reaches the child and surfacing a minor in acute distress to a parent or safeguarding professional. By operating at the interpersonal layer rather than within a single walled garden, this approach addresses cross-platform offender behaviour and provides a consistent safety envelope independent of the pace or uniformity of platform-level compliance.
