UK Crown Prosecution Service Updates Charging Guidance on AI-Generated Child Abuse Images

The Crown Prosecution Service published revised legal guidance on 18 September 2026 clarifying that AI-generated and manipulated images of children constitute indecent images under existing UK law, regardless of whether they depict identifiable real children. The updated guidance confirms that creating, possessing, or distributing synthetic child sexual abuse material is prosecutable under the Protection of Children Act 1978 and the Criminal Justice Act 1988, and that defendants cannot rely on the artificial origin of an image as a defense. The CPS emphasized that the law focuses on the nature of the image itself rather than the method of production, closing a perceived gap that some offenders had attempted to exploit.

Clarifying criminal liability for synthetic material is necessary but addresses harm after creation and distribution have occurred.
