The Kids Online Safety Act Explained In 2026

Guardii Analysis

The Senate's version of the Kids Online Safety Act, advanced by the Senate Commerce Committee on 5 August 2026, includes a duty of care provision requiring covered platforms to exercise reasonable care in the creation and implementation of any design feature to prevent and mitigate harms to minors. The House passed a separate package, the KIDS Act, on 29 June 2026, which contains a version of KOSA with the duty of care removed. The duty attaches to design features rather than content, and does not require a platform to stop a minor deliberately searching for information.

A duty of care applied to design features relies on ex post evaluation; real-time pattern detection intervenes at the moment of harm. Guardii, backed by Startmate and operating as a Meta Business Partner, deploys anti-grooming, anti-sextortion and anti-CSAM detection modules within direct-message conversations on Instagram, Snapchat, Discord, Roblox and other platforms, blocking or flagging hostile contact before it reaches the target and surfacing a child in acute distress to a parent, school or professional. It detects threat patterns rather than reading every message, enabling rapid escalation to the appropriate authority in an emergency without waiting for a design audit or regulatory finding.
