TAKE IT DOWN Act secures first conviction in Ohio for AI-generated non-consensual intimate imagery targeting minors, April 2026

Guardii Analysis

In April 2026, an Ohio man became the first person convicted under the federal TAKE IT DOWN Act, enacted in May 2025, for using artificial intelligence to create and distribute non-consensual intimate images targeting both adults and children in his community. The Act makes it a federal crime to knowingly publish or threaten to publish non-consensual intimate imagery, whether authentic or AI-generated, through an interactive computer service, with penalties of up to two years imprisonment for adult victims and up to three years for minors. The conviction establishes a legal precedent for federal prosecution of AI-facilitated abuse and demonstrates operationalization of the 48-hour takedown requirement for verified victim requests.

The TAKE IT DOWN Act addresses removal after publication but does not detect hostile contact before imagery reaches a victim. Anti-sextortion and anti-CSAM detection deployed by Guardii, a Meta Business Partner, identifies coercive escalation and attempts to share non-consensual intimate imagery including AI-generated material in real time within direct-message conversations, blocking or flagging the contact before it reaches the target and surfacing a child or young person in crisis to a parent, school or professional. Pattern-based interception at the messaging layer provides a structured escalation pathway to law enforcement with a threat profile and conversation shape, complementing takedown obligations with pre-contact prevention.
