State Lawmakers Looking At Restrictions on AI-Generated CSAM

Pennsylvania state lawmakers are preparing legislation that would require technology companies to prevent the creation of AI-generated child sexual abuse material, maintain reasonable safeguards, and respond to reports of such material being produced on their platforms. The bill, not yet formally introduced, would authorize the state Attorney General to seek injunctions and civil penalties against companies that fail to comply. The proposal follows a federal court ruling that AI-generated CSAM does not meet the threshold for criminal liability under existing statutes, creating a gap between the scale of synthetic abuse imagery and the legal tools available to prosecute offenders or compel platform action.

Prevention at the point of production or distribution offers a more immediate safeguard than litigation after harm has occurred.
