South Korea Approves Amendment to Criminalize AI-Generated CSAM

On October 10, 2024, the government of South Korea approved an amendment to the Special Act on the Punishment of Sexual Crimes to explicitly criminalize AI-generated child sexual abuse material. The amendment expands South Korea's existing framework, which previously required that depicted characters clearly and undoubtedly appear to be children, addressing a legislative gap identified by the Supreme Court in 2014.

Targeted detection of AI-generated and manipulated CSAM in direct messages requires pattern analysis that distinguishes creation, distribution and coercion behaviours from possession of legal content. Guardii's anti-CSAM detection module, developed in partnership with Meta, identifies distribution chains and production indicators within encrypted messaging environments across Instagram, Snapchat, Discord and Roblox, flagging high-risk exchanges before imagery reaches a child or re-victimizes a survivor, without requiring platforms or investigators to view every file.
