Pornography Age Verification Laws: State-By-State Regulations After SCOTUS Ruling

Guardii Analysis

As of early 2026, following a U.S. Supreme Court ruling upholding the constitutionality of age verification laws for adult content, more than 30 states have enacted or are implementing age verification requirements for websites where a substantial portion of content is sexually explicit, typically 33.3 percent though Kansas sets the threshold at 25 percent. Arizona and California laws requiring digital identification or age assurance are effective 1 January 2027. Some states require websites not to retain user data used for verification; Florida mandates an anonymous option and Kentucky requires removal of personal data after access review.

Age gates that verify identity for access to adult content create a privacy burden for compliant adults and establish no mechanism to detect contact-based harms once a young person is already on a platform, whether through misrepresentation or an all-ages service. Guardii's age-inappropriate contact filter identifies adults initiating conversations with children on social platforms, gaming environments and messaging apps in real time, flagging the pattern of contact rather than requiring every user to prove their age at sign-up. Detection targets the predatory behavior itself, not the venue, and works across the channels where grooming, sextortion and exploitation actually occur.
