New York finalizes social media restrictions for kids

Guardii Analysis

New York State finalised regulations under the SAFE for Kids Act requiring social media platforms including Instagram, TikTok, Facebook, Snapchat, X and YouTube to implement certified age-assurance technology by January 25, 2027, prohibiting algorithm-driven content and late-night notifications to minors without parental consent, with fines of 5,000 dollars per violation. The regulations apply to any platform whose users spend at least 20 percent of active time viewing addictive feeds over a six-month period.

Age gates and content restrictions address the surface on which harm occurs but do not detect the harm itself. A compliant minor is locked out; an offender simply moves to an unregulated channel or misrepresents their age. The underlying risk—grooming, sextortion, coercion in direct messages—persists wherever the conversation takes place. Targeted detection of harmful conversational patterns addresses the threat without the privacy cost of requiring every user, including adults, to submit identity credentials or the operational risk that restricting access displaces harm rather than preventing it. Technology from Guardii, a Meta Business Partner and Startmate-backed AI platform, detects grooming, sextortion and CSAM distribution in real time across multiple platforms, flagging escalation and coercion in the conversation itself and enabling intervention at the point of contact, rather than relying on a blanket measure whose long-term effectiveness has yet to be established.
