New Mexico Court Orders Meta to Halt End-to-End Encryption on Instagram for Five Years

A New Mexico court ordered Meta to maintain for five years its previously announced cessation of end-to-end encryption on Instagram, alongside other measures including elimination of push notifications for users under 18 during nighttime and school hours and limiting minors' platform use to 90 hours per month. Trial evidence presented internal Meta materials showing executives warned that encrypting Facebook and Instagram messaging could dramatically reduce child exploitation reports to the National Center for Missing and Exploited Children and could impede referrals involving child exploitation, sextortion, terrorism and school shooting threats. The ruling follows similar efforts in other states, including a 2024 emergency order request by Nevada Attorney General Aaron Ford to stop Meta from providing end-to-end encryption to minors in Nevada, arguing that encryption protects predators and impedes law enforcement efforts to protect children.

Prohibiting a platform from deploying encryption raises a distinct set of risks including exposure of legitimate communications to interception, data breach or unauthorised access by hostile actors, state authorities or the platform operator itself.
