Minnesota vs. xAI on nudification law

Minnesota Attorney General Keith Ellison announced the state is actively enforcing the nation's first nudification app ban, which passed in May 2026 with only one dissenting vote and took effect 1 August 2026, despite an ongoing legal challenge from Elon Musk's xAI seeking to block the law. The statute targets apps that allow users to take an innocent photograph of another person and use AI to generate pornography, carrying penalties of up to 500,000 dollars per violation, and applies to depictions of women and children, who comprise 99 percent of victims. A federal judge denied xAI's request for a temporary restraining order, allowing the law to take effect while the underlying First Amendment challenge proceeds in court.

Banning the distribution of an application addresses supply but does not prevent offenders from accessing unregulated nudification tools hosted outside Minnesota's jurisdiction or from using those tools to generate deepfake abuse material targeting children within the state.
