Minnesota Enacts First U.S. State Ban on Nudification Technology

Guardii Analysis

On August 1, 2026, Minnesota became the first and only U.S. state to ban companies from making nudification technology available to the public. The law prohibits the owners of websites, applications or programs from allowing users to access, download or use technology that nudifies images or videos, turning photos of clothed individuals into hyperrealistic sexual imagery or converting photos of children into child sexual abuse material. The legislation targets the platform or tool provider rather than individual users, applying civil penalties rather than criminalizing individuals, and was designed to address the ease with which any person, just by appearing in a public place, could have their image weaponized through widely available AI nudification tools.

Blanket bans on categories of technology constrain the supply side but do not address demand or the underlying behavior of offenders who seek out or request nudified images of minors. When a predator solicits a nudified image of a child, requests that a child use such a tool, or threatens to create or distribute a deepfake to coerce compliance, the coercion and the threat precede any use of the tool itself. Guardii intercepts that contact in real time. The anti-sextortion and anti-CSAM detection modules identify manipulation, requests for intimate images, threats to distribute fabricated or real material, and patterns of escalation that signal an imminent risk to a child, enabling an intervention at the point of contact before the technology is ever deployed and before a child is coerced into complying or producing self-generated material. By surfacing threat patterns as they develop, detection provides both a safeguard for the child and evidence of intent for civil or criminal enforcement, regardless of the legal status of any particular tool in any particular jurisdiction.
