New York has released proposed rules to implement age assurance requirements under the SAFE for Kids Act, marking one of the first attempts in the United States to translate legislative age-verification mandates into enforceable technical standards. The proposed rules require platforms to use commercially reasonable age-assurance methods and establish certification standards for compliance, though Georgetown University researchers have identified critical gaps: the rules rely on quantitative circumvention metrics rather than qualitative certification, fail to mandate zero-knowledge proofs for privacy-preserving age verification, and lack requirements for public disclosure of complete certification reports.
