EU Digital Services Act: First enforcement actions target child safety failures

Guardii Analysis

The European Commission announced on 1 October 2024 that it has opened formal proceedings against a major social media platform under the Digital Services Act for suspected failures to protect minors, including inadequate age verification, risks from addictive design and insufficient access to data for researchers. The Commission's preliminary findings indicate the platform may have breached obligations to assess and mitigate systemic risks to children's mental and physical well-being, with potential fines of up to six percent of global annual revenue.

Guardii's cross-platform detection architecture addresses the systemic-risk obligation at its operational core. By monitoring for grooming, sextortion, child sexual abuse material and cyberbullying patterns in real-time message streams on Instagram, Snapchat, Discord and Roblox, the platform surfaces children at acute risk to parents and safeguarding professionals without creating a surveillance feed, enabling rapid escalation to law enforcement where an imminent threat is identified. This pattern-based approach mitigates the harms the Digital Services Act seeks to prevent while preserving the privacy of users engaged in age-appropriate communication.
