EU AI Act Bans CSAM and Nudification Generators from December 2026

Guardii Analysis

The European Union Digital Omnibus package has amended Article 5 of the AI Act to impose an outright prohibition on AI systems that generate child sexual abuse material or non-consensual intimate imagery, including nudifier applications. The ban, which takes effect on 2 December 2026, applies both to systems designed to produce such outputs and to systems where those outputs are reasonably foreseeable without adequate safeguards, creating direct criminal and regulatory liability for developers and operators.

When access restrictions take effect weeks from now, they will create a hard barrier at the point of availability but do nothing to address the harms that occur when CSAM or coercive imagery is created and circulated within closed networks or across platforms headquartered outside EU jurisdiction. Real-time detection of grooming patterns, sextortion escalation and coerced image sharing in direct messages, the core capability Guardii deploys as a Meta Business Partner, intercepts the abuse itself rather than relying on post-generation removal, and operates across the fragmented social and gaming ecosystems where children actually communicate, irrespective of where the model or the platform is domiciled.
