California Governor signs AB 3080 requiring social media platforms to remove AI-generated child sexual abuse material

Guardii Analysis

California Governor Gavin Newsom signed Assembly Bill 3080 into law on 13 October 2024, requiring social media platforms, online applications and internet websites to remove or disable access to any reported content depicting a child in a sexually exploitative manner, including AI-generated and digitally manipulated images, within 36 hours of receiving notice, and to provide a mechanism for victims to report such material directly. The law also establishes civil penalties and a private right of action for victims, and takes effect on 1 January 2025.

Detection before distribution is the operational frontier that removal mandates presuppose but do not specify: once AI-generated child sexual abuse material has been shared, the compliance clock has already started and the harm to the victim is underway. Guardii's anti-CSAM detection module—which identifies both photographic and AI-generated abuse imagery in real time as it moves through direct-message channels on Instagram, Snapchat, Discord, Roblox and other platforms—blocks hostile contact before it reaches the target and surfaces the incident for rapid escalation, closing the window between creation and notice that post-hoc removal requirements leave open. For victims, that means interception at the point of contact rather than remediation after exposure, and for platforms operating under AB 3080, it means structural compliance with a harm-reduction standard that takedown alone cannot meet.
