California Enacts Massive Package of Laws on Children's Online Safety
Guardii Analysis
California signed into law on September 28, 2026 a comprehensive package of child online safety measures that Governor Newsom described as the strongest in the nation. AB 1946 expands platform detection obligations for child sexual abuse material, redefines CSAM to include AI-generated digital forgeries, removes the requirement that the complainant appear in the reported content, and mandates human review where no hash match exists, retaining timelines of 48 hours to block, 72 hours to approve, and seven days for final determination, with penalties of 250,000 dollars per day of violation.
When legislative mandates require human review alongside hash-based CSAM detection, the operational model assumes that harmful material has already been uploaded to the platform. An anti-CSAM detection module that intercepts synthetic and photographic abuse material at the point of upload, before it enters the platform ecosystem, can meet the substantive child-protection objective of the California statute while reducing the burden on human reviewers and shortening the exposure window for victims. Guardii, backed by Startmate and a Meta Business Partner, deploys precisely this architecture across Instagram, Snapchat, Discord and Roblox, flagging or blocking hostile content in real time without creating a persistent record for later human triage.
