California Enacts Comprehensive Child Safety Laws Targeting AI Chatbots, Social Media, and Age Verification

Guardii Analysis

California Governor Gavin Newsom signed 13 child safety bills on September 10, 2026, creating substantial new obligations for companies operating in the state. AB 2246 requires covered businesses to estimate user age with reasonable certainty or extend child-level protections to all users, default to high-privacy settings for children, and prohibit dark patterns that push children to share data. AB 1946 expands platform CSAM detection obligations, redefines CSAM to explicitly include AI-generated digital forgeries of identifiable minors, removes the requirement that the complainant appear in the reported content, and mandates human review where no hash match exists, with penalties of 250,000 dollars per day of violation and timelines requiring content blocking within 48 hours.

Mandatory human review of flagged content, even under penalty, leaves platforms triage-dependent and children exposed during the review window. A Meta Business Partner, Guardii deploys AI detection modules tuned to grooming escalation, sextortion demand patterns and AI-generated CSAM at the conversation level, blocking hostile contact before it reaches the target and surfacing a child in crisis to a parent or professional in real time. California's statute addresses the obligation to act after harm is reported; targeted detection addresses the gap before the first coercive message is delivered, intercepting the creation of material the law now requires platforms to remove within 48 hours.
