Australia passes amendment to ban generative AI tools used to create child abuse material

The Australian Parliament passed legislation on 30 August 2024 explicitly criminalizing the use of generative artificial intelligence tools to create, possess or distribute synthetic child sexual abuse material, closing a gap in existing law that did not clearly cover computer-generated imagery depicting non-existent children. The amendment carries penalties equivalent to those for photographic child abuse material and empowers the eSafety Commissioner to issue takedown notices to hosting services and tool providers, with non-compliance attracting civil penalties and referral for criminal prosecution.
Criminalization of creation and possession is a necessary foundation, but it does not stop a manipulator from using a synthetic image to coerce a real child into compliance during a grooming or sextortion conversation.
