Alabama Child Protection Act Criminalizes AI-Created Sexual Depictions of Children, Grants Families Private Right of Action

Guardii Analysis

Effective October 1, 2024, the Alabama Child Protection Act criminalizes the use of AI to create sexual depictions of children, with penalties aligned with existing child pornography law. The Act notably grants families of victims the right to file civil suits against predators, establishing a private right of action that exceeds protections in comparable state statutes and enabling direct legal recourse for survivors.

Civil remedies provide retrospective redress but do not prevent the initial creation or distribution of AI-generated abuse imagery targeting a specific child. Detection systems that monitor for the preparatory behaviors behind AI-generated CSAM, such as soliciting source photographs, issuing threats to generate deepfakes, or distributing fabricated imagery to coerce compliance, allow intervention before a predator inflicts reputational and psychological harm. As a Meta Business Partner, Guardii deploys anti-CSAM and anti-sextortion filters that recognize these upstream indicators across major platforms, surfacing high-risk conversations to parents, schools or law enforcement in time to prevent the creation or weaponization of synthetic abuse material.
